Terms and conditions of using Quafere

 

Quafere platform (Quafere): is an online platform allows female users those can provide female salons services to offer what she has of skills as services to female clients those willing to benefit from these services. Quafere platfrom allows clients to choose from available Service Providers to do their services.

Service Provider (Specialist): are those whom willing to provide usual Female salons services such as beauty services and others.

Client: is that person who request Service Providers to do certain service(s) through Quafere Platform.

 

All written terms and conditions represents an official agreement (contract) between all three parties Quafere Platform, Service Providers and Clients.

 

Quafere platform allows Clients to call any available Service Provider to do required services at their location according to their preferences.

 

Any use of Quafere Platform service(s) by any users (Client or Service Provider) is considered that you accept and agree all terms and conditions mentioned here. Based on that, you have to make sure that you read and accept all points mentioned in this agreement. Otherwise, don't use it.

Quafere Platform management and administration has all rights to modify or change this agreement at any time without prior notification, and your responsibility as a user (client or Service Provider) to review terms and conditions multiple times annually and at the time of updates notification by accessing this link ( Terms & Conditions ) this is applied as well on privacy policy to know about how Quafere Platform deals with users information that you provide to us. Eligibility for the service:

This is an endorsement and guarantee from you that you:

1-      have not been banned previously or you account was not deactivated from Quafere Platform.

2-      Not a competitor of Quafere Platform and you do not provide any service or product that compete Quafere Platform.

3-      You have full authority and abilities for contracting with us and you are not breaching any law or contracting requirements and you do not have any criminal record. Plus, you are confirming that you are totally clear from any arrest or claims from security authorities.

 

Privileges scope:

Quafere gives you a non- monopoly privilege, non-transformable, not allowed to practice subcontracting, and not a subject of cancelation. Our services are provided just to use them for personal use (for example and not limited to not allowed to use it for trading purposes). According to this contract, you should:

·         Never release/enable, rent, lease, re-sell, distribute or subcontracting our services to any third party.

·         Never modify/edit, translate, summarize, or make sub-business based on extraction or reverse engineering of Quafere codes and designs. And similar activities such as reaching or trying to reach the source algorithms and codes of Quafere and its designs, services, pictures, texts, media, data, or any related items or information that provided by Quafere or any third party that works with quafere.

·         Never modify, edit or delete or doing similar actions on any copyrights or official notifications in services.

·         Never move/shift or distribute our services or allow them to be available for use in other than agreed way in this contract.

·         Never share your user name, your password with anyone. And never allow other party to gain anything can allow them or others reach our service out of this contract.

·         Never buy or sell any goods or products with a person through a relationship that created via Quafere whether you are a client or specialist.

 

Copy rights:

All of copy right of Quafere platform and all media that related to it, that are provided within its content or publish though its channels (for example and not limited to: any content, like images, that Quafere publishes through its Platform or its channels and all other contents that Quafere publishes) is owned by Quafere and Quafere has full authority to control, manage and use them according to its interests. And you should never reproduce or allow anyone, for any reason, to use or reproduce any content, service, trademarks that appears via Quafere services.

And Quafere has the full authority to control, manage and use all the content that are uploaded or provided to it by any user (Client or Specialist) according to Quafere interests and how Quafere decideds to use tham without any prior notification or Legal liability.

 

 

Payments:

·         Quafere has all rights to change, remove, or add fees for using Quafere platform or its services or both. In case of any action is taken in this regard, Quafere will notify you and you have your right to proceed with us or to terminate your contract.

·         According to the market and the strategy of Quafere, Quafere is responsible for setting the fees that can be taken from Clients or Specialists or both. Clients and Specialists have their full rights to proceed with Quafere or to terminate their contract while anyone proceeded with us after the change that will be considered as a clear acceptance of the change.

·         In case of the service is a subject of cash payment, the specialist is fully responsible for taking the invoiced money directly after the required service is completed and will be fully responsible for that collected money. And you agree to pay to Quafere the agreed fees for any service went through our platform. And for specialists, you should accept any valid coupon that used by the client and Quafere will compensate you according to the request nature.

·         You acknowledge and agree that you will be always committed to the fidelity  and honesty regarding the value and truth of operations, etc., and you agree that in case of any direct or indirect fraud, manipulation, deception or abuse is discovered, you will be subject to suspending your services and blocking them from the “Quafere” platform, in addition to, the right of Quafere in collecting an abuse fine of 1,000 Saudi riyals, in addition to the right of Quafere to claim compensation for all damages that have resulted or will result as a result of this fraud, manipulation or misuse. Plus, the one who did this abuse will be completely responsible on this mistake in front of government.

·         Quafere Platform is designed in a proper way to save the rights of all parties. Therefore, the client should pay the required amount of booked services or products at the time the application requests. Payments should be paid cash to the specialist or via E-payments that prepared in Quafere platform before, in the beginning, during, or after having the requested service as the application is designed. And, the client is fully responsible for legal consequences that will show up if the payment was not done at its time.

·         Quafere has all of the rights to ban a client in case she did not pay the due amount until the required amount is paid for below cases:

o   The provided service.

o   In case of manipulation.

o   Repeated non-completion of operation.

 

Pricing criteria:

The specialist is the only one allowed to put the price of her services. Client has the choice of exploring the group of specialists in search page and choose the suitable specialist for her.

And, the client is allowed, as well, to directly select a specialist from suggested specialists to assign her order to her without referring to search page.

 

Sending an order to a specialist is considered as the client is already accepted her selected order to be assigned to selected specialist and the client is accepted the price which is considered as a commitment from her to pay for this order as mentioned in payments section.

 

Compensations:

By accepting this agreement of using Quafere platform you agree to defend and stand for Quafere, Quafere related parties and authorization parties, all of its representatives, its administration and management, all of its employees, all of its users, its lawyers and all of its agents and never harm them. Plus you agree to discharge them from any claims, costs, damages, losses, liabilities and expenses (including attorneys’ fees and costs) arising out of or related to:

·         Breaching, Infracting or violating any of this agreement conditions, any regulation or any policy whether mentioned in this agreement or not.

·         Breaching, Infracting or violating of any others' rights.

·         Abusing/misusing Quafere platform and its services.

 

Legal responsibilities:

All information, recommendations and/or services, that are provided to you through Quafere platforms or its related website, are provided for your information and they are not directions unless it is mentioned there that it is an instruction by using a clear expression. Quafere will be trying as possible to update all provided information and to keep them accurate but it is not guaranteed that the website or the Quafere platform is free of some mistakes, flaws malware or viruses, in addition, it is not guaranteed that all information are correct and accurate for all the time.

No responsibility on Quafere related to any damage that caused by using (or inability to use) Quafere website or its platform including, but not limited to, any damage that resulted from malwares or viruses. And Quafere have no responsibility of any damage resulted from incorrect information or incomplete information on Quafere website or Quafere platform unless that damage resulted from intentional action or clear negligence from Quafere side.

 

The quality of services that requested though Quafere platform is the responsibility of the specialist. Quafere, under any condition or circumstance, never take any responsibility of provided services by specialists or the responsibilities that resulted from those services. In addition, Quafere do not accept any responsibility of any action, behavior, negligence, or all of them from both of clients and specialists. Any complain related to the service itself, the client can raise it directly to the specialist and both of them can rate each other after the service is completed.

 

Responsibility scope:

No guarantees (explicit or implicit) are provided by Quafere in terms of provided service since they are all provided as it is. And Quafere platform clearly disclaims, to the farthest legal limit according to the law, its responsibility of all guarantees, including but not limited to warranties of fitness for a particular purpose, suitability for specific specifications and markets or the ability of selling copy rights. Plus, Quafere do not guarantee the accuracy of provided services, services time and durations, or the result that Specialist/ Client achieved or not achieved. And Quafere platform, its agents, its licensor or its related entities has no responsibility regarding direct or indirect damage/harm, sanctions, or special damage/harm, Incidental or consequential damages (for example but not limited to: damages that resulting from lost profits, business interruption, loss of business information or other financial loss, or health damage) that resulting from, direct or indirect, service reachability and its use, disability of using provided service(s), or relying on them.

Any offer, advertisement, competition, that was not announced by Quafere in its official channels (its website, its SMS, its social media channels) that are managed by Quafere team are not considered and Quafere has the right to take any legal action against it. And, neither the specialist nor the client has the right to request from Quafere to apply that. In addition, there is no responsibility on Quafere regarding any fraud that happened through fake or misleading advertisement or content held in an unofficial channels on behalf of Quafere.

Quafere does not bear any responsibility for abuse or verbal, psychological or physical abuse, and the party who committed any of the mentioned act will be fully responsible.

 

Security:

You confess that you and only you own the full responsibility on the privacy of the services and you are responsible for using our services by any other person that can access you account or can have your username and your password or any type of accessibility to your account. And you acknowledge that you should inform Quafere immediately in case you noticed any loss, any type of theft, any unauthorized use of any IP, username or password, or any other way of unauthorized access to our services.

 

Dealing with others:

While using Quafere website, Quafere platform or Quafere services there might be some URLs (Links), that are owned and managed by other parties, for the purpose of messaging them or to by their products/services or to participate in promotional activities.

While using Quafere related website, platform or services, you might exchange messages, buy products/services or participate in promotions with others whom won them, advertisers or sponsors while they offer their products/services through those URLs which will take you to out of Quafere related website, platform or services and they are out of Quafere control. So, you should consider their policies and their terms and conditions which are independent than Quafere's policies and terms and conditions.

Quafere disclaim any responsibility related to the content that provided through their URLs and any activities. And Quafere can not be held accountable for that.

According to that you are fully responsible for any risk, issue or problem that results from visiting those URLs.

You should notice that some websites or links use cookies, and they sometimes collect user information or asking for personal information. Therefore, we recommend that you review their terms and conditions or privacy policies that related to those sites/URLs before dealing with them.

 

Duration of contract and its termination:

The contract that agreed on/conducted between you and Quafere, is unlimited time. And you have the right at any time to terminate it by delete the platform that installed on your smart phone and you can stop using your username and password at any time. While money settlement will continue until your account settlement reached zero.

Quafere has the right to terminate you contract or suspend your account, with immediate effect without prior notification, at any time, if any case of the below is discovered:

·         If you violated or breached any of the User terms and conditions.

·         If Quafere found that you misuse or abuse its website, Platform or services.

·         If you offended Quafere by an explicit or indistinct act.

 

invalidity/annulment of a condition or more:

invalidity or annulment of one term or condition never effect the remaining point of the contract.

If one term/condition in this agreement/contract is invalid, annulled, not applicable, not applicable in certain circumstances or unacceptable according to logical and justice measurements, then this term/condition can be replaced by another acceptable one that considers all parties' rights/interests as possible, and it should be aligned with the judgment of invalid/annulled one. That should be with consideration of the purpose of the term/condition and the purpose of the agreement/contract.

 

Service change/modification and user terms and conditions:

Quafere reserves the right of modifying/changing the terms and conditions in this agreement/contract according to Quafere's directions and vision. Plus, the rights of changing its services or the platform as well as suspending or terminating them at any time (for example but not limited to: adding new features or database or content). And that will be communicated through Quafere's official channels. Quafere can apply limits on some/all provided features/services or can apply total or partial limits on your accessibility to its services. That will be without a prior communication or legal responsibility.

 

Notification:

Quafere can notify its users regarding any subject through sending a notification within its Platform notification center, through Email to your Email address or through post office.

 

Applicable Law and Dispute Resolution:

These User Terms are subject to and apply to the settlement of any dispute, claim, any dispute arising out of or relating to these User Conditions, any violation/breach of it, contract termination, its enforcement, its explanation, its accuracy and the usage of its website, its platform and its services. All of this agreement points are subject to the laws and regulations applicable in the kingdom of Saudi Arabia.

 

Terms and Conditions of Specialists:

This agreement is representing an official contract between Quafere Foundation for E-Marketing, the owner of "Quafere" trademark and Specialists (female service providers, services that are usually provided in women's salons). And Specialists terms and conditions controls service provider's usage of Quafere – SP which is a mobile application (part of Quafere platform) that allows Specialists to offer their services, within the scope of Female salons services, at the location that has ben chosen by the client since Quafere allows clients to choose the suitable Specialist to provide her required services.

Any use of Quafere platform is considered as an acceptance of terms and conditions (total document/total contract). According to this, you should never use Quafere platform in case you don't agree on this contract totally.

Quafere platform has all right to make any change/modification at any time to this contract without prior notification and it is your responsibility to periodically review terms and conditions to know about any updates that has been applied as well as it is your responsibility to check the privacy policy to know how Quafere deals with all information that received from users.

 

Entitlement to services:

You admit and guarantee the below:

·         You are not banned previously from Quafere services at any time.

·         You are not a competitor of Quafere as well as you don't provide/offer any product that compete any Quafere service.

·         You have full power and authority to contract and that you will not be in breach of any law or contract.

·         You are an independent and not working as an agent, representative, distributor or partner of Quafere. And you don't the right, directly or indirectly, to represent yourself as a representative of Quafere. And you do not have the right to act in a way that will make any commitment on Quafere without a written authorization/approval from Quafere. Once you got the approval you have to act within its limits and purpose. In addition, you have no right to provide/offer any promotions to any one on behalf of Quafere. And you admit that the responsibility of your violation/breach will be on you and only you regarding all commitments that resulted from your act and It exposes you to legal prosecution and to bans your use of Quafere.

 

Commitments and pledges:

You admit and guarantee the below:

·         You should comply with all applicable laws and regulations in the Kingdom of Saudi Arabia.

·         You should provide correct and accurate information to Quafere and keep them updated.

·         You should read an comply with all notifications you receive from Quafere management/Administration.

·         You will never produce/make subcontracts. Or, issuing, publishing, transferring, distributing, executing, offering, selling or re-categorizing the Quafere's services. Otherwise, you will be considered as you are violating the use or commercially exploited the service except as permitted under this contract.

·         You should never use information, content or any data you access or obtain through Quafere services for any purpose other than for personal use and you will use the platform and services exclusively for your own purposes and will not sell them to any third party (including but not limited to exposing other user's information to anyone else).

·         You agree and approve exchanging your information with all required parties according to Quafere's decision in order to provide you with services that you need.

·         You should use the platform for legal use according to its purpose, and never use it for fraud.

·         You should be committed to adopting highest standards to maintain the safety and cleanliness of the materials and tools that are used.

·         You should adhere to the highest standards of health and personal hygiene/.

·         You are committed to sterilizing tools before using them.

·         You should never use the Quafere platform to cause harm or inconvenience to anyone.

·         You should never hinder the proper operation of Quafere services.

·         You should never attempt to harm the Service of Quafere in any way.

·         You should never copy or distribute the platform or other content without written permission from "Quafere".

·         You should maintain your username and password of your account or any method of identification that we provide to you and that allow access to your account, in a secure and confidential manner.

·         You should provide Quafere with all evidences of your identity according to Quafere's discretion.

·         You should only use wireless Internet devices or a 3G and above data account that you are authorized to use.

·         You acknowledge the right of Quafere to refuse to provide service(s) to you or suspend your use of the platform without giving any reason.

 

Authorization scope:

Quafere grants you a non-exclusive, non-transferable, non-assignable, non-sublicensable license to access and use its services for your personal use (including but not limited to: not for any commercial purposes), in accordance to this contract, so you should:

·         Never make the services available or to rent, lease, assign, resell, distribute or sublicense these Services to any third party.

·         Never modify, subtract, translate, summarize, create sub-works based on decoding, reverse engineer the design of “Quafere” platform or other actions like identify, attempt to identify or attempt to access the source code, the internal design of the services or any other Text, multimedia (photos, audios, video files), data or other information provided by Quafere or third party service providers.

·         Never delete, change, or modify any copyright or other official notice contained in the Services.

·         Never intentionally transfer, distribute the services, or allow the services to be downloaded for use other than as specified herein.

·         Never claiming to grant or allow access to the services to anyone other than yourself.

·         Never allow sharing your username/password or any other accessibility methods  to Quafere services.

·         Never sell or buy any product/service other than offered in Quafere platform. And that should be within Quafere platform not in personnel agreement between users.

 

Return and Refund Policy::

Regarding to provided services by a specialist, Quafere platform is not responsible about any mistake that happen by the specialist since the plat form is a mediator between the client and specialist. The platform is showing all available specialists at the request time and location and the client is the only one can choose from the list provided. And the same for the specialist, since she is the only one can accept and provide services according to her evaluation. Considering that the compensation are not mandatory on Quafere platform and if Quafere platform compensate someone, this should be taken as (gain customer loyalty).

Regarding sold products through Quafere platform (if any), if they are not approved from Quafere Platform, this will be considered as a breach of contract and Quafere is authorized to take a legal action against both parties. And if they are authorized from Quafere platform and Quafere is only advertising them, then, Quafere is has nothing to do with it, both parties (seller and buyer) should follow the policy provided by the seller. But, If Quafere is doing the coordination of selling products, the buyer should inform Quafere about the issue within 24 hours of receiving the shipment. Then, Quafere platform will check the issue and take an action within five business days and the buyer should provide all evidences that supports them. Any issue without clear evidence, Quafere platform has the right to is not responsible of any harm or damage and the platform has the right to close the record as there is no clear helpful/supportive evidence.

 

Refund can be through recharging the wallet of  eligible account for compensation or can be through the same payment method. This is as Quafere decide.
